Introduction to Law
Cursusdoel
After completing this course students are able to:
Test 1 – written test (30%, goal 1-5)
In the first exam the student’s general knowledge on learning goals 1-5 are tested with a particular emphasis on the different fields law and the relation between these fields of law. Students also need to show they are familiar with the basic concepts of law as well as the sources of law and the difference between civil vs common law.
Test 2 – written test (30%, goal 1-7)
In the final exam the student’s basic knowledge of international law, including basic human rights, European law and the interaction between international law and/of European law and national law is tested. Students also need to show they have basic knowledge of the rule of law, basic concepts of legal philosophy and legal reasoning.
Paper (30%, goal 8)
Students also need to write an essay. The essay should focus on a (legal) question that is relevant in the field of Refugee Law. During the first half of the course a list of topics will be published on Blackboard. Students can choose one of these topics.
Participation (10%, goals 1-4)
The grade will be based on the presentation(s) given in class (including the hand-out of 400 words max), as well as on participation in the discussion of these presentations and assignments made during the last week (credibility of asylum claims)
- Have an understanding of the basic concepts of law and the sources of law;
- Can explain the most important legal concepts and actors in the field of law;
- Have a basic understanding of the difference between common law and civil law;
- Are able to describe the different fields of law (private law, criminal law, constitutional law and administrative law);
- Understand how conflicts are resolved within these fields of law and themselves offer solutions to simple cases;
- Have an understanding of the concept of rule of law, basic concepts of legal philosophy and are familiar with legal reasoning;
- Have an understanding of international law, European law and national law and the relationship between them;
- Have a basic understanding of human rights and can apply it on to a specific field of law, i.c. Refugee Law;

Vakinhoudelijk
This course provides students with an introduction to law. This course starts with the basic concepts of law, the actors in the field of law and the different sources of law. The difference between common law and civil law is also discussed in order to give students a better understanding of the different traditions in the Western jurisdictions. After this introduction, different fields of law are briefly discussed, illustrated with examples taken from cases. In the second part of the course, we start with some basic concepts as well, but this time the focus is on the rule of law, legal philosophy and legal reasoning. After that, the relation between national law, regional law (i.c. European Law) and international law is discussed. This is illustrated by discussing some relevant topics from Refugee Law. This field of law is an excellent example of interaction between international law (Refugee Convention), regional law (Common European Asylum System) and national law (Dutch Aliens Act 2000). In the last two lectures students need to take the role of decision-maker in order to show students how the application of law in practice works and what kind of predicaments one might encounter.
Format
The course requires a good level of preparation. In each session, the main aspects of the scheduled topic are discussed using the assigned literature as the base. Students are expected to participate actively; they each give at least one presentation on a specific topic, such as a court decision or a piece of legislation, followed by a general discussion in class on the topic.
